Urgent : Desi Consultant Not Giving H1 reciept

I am currently on OPT and i came to know that if I get H1B for year 2009 My Desi Employer will not give me the EAC Reciept. What can i do if the Employer denies to give me the EAC reciept in case i have to Transfer my H1 ?
Please can some one help me with this.

I am confused about the language used by you and few other posters.

Many people are using the word 'consultant' when they really mean the 'employer' or the 'body shop' or even the 'recruiter'.

By consultant, doesn't refer to to you, the employee? After you are placed as consultant at client side company.

Sorry for my ignorance. But I would like to know the reason for such misnomer.

... many people just don't seem to know the exact terminology.

Employer --> Consulting Company
Employee --> Consultant

All Right OP,

You, as a consultant of your consultant, cannot do anything if the consultant does not give her/her consultants a Receipt number. An H1 is a consultant's petition and a consultant can only get the receipt number from the consultant.

Go figure !

Nothing. You just have to curse yourself for going with such a consulting company. Let me guess, you even paid for your H1b.

... then I am sure being a DON you should be able to find a way out for yourself.

Consult a good attorney, get hold of a very good company and let the attorney work this out for you.

Attorney's notice to your current employer will have more weight in getting your documents then as a DON yourself.
