H1 B/ advance parole/ marriage

  • H1 B/ advance parole/ marriage

    I am a physician in States now for 4 years I came to USA on B2 and switched to H1, I applied for a EB1 and got my advanced parole. I want to go back to my home country and get married ,

    WOULD I NEED A AN H1 stamp on my passport or can I use my advance parole??

    If I donot get an H1 stamp can I still bring my wife on H4.

    Would appreciate you guidance

    You should not use your AP or EAD if you want the dependent in US on a H4. In your case, you need a visa stamp to re-enter on a H1 if you want to bring your spouse along on a H4. Once the spouse has her I485 applied as your derivative, you are free to use EAD and AP.

        Only after your marriage. She has to be inside US if you are going for an Adjustment of Status I485 You can apply while she is out of the country using CP (Consular Processing) and it could take a loooooong time for that to get approved depending on your PD and your country of birth.

          Most important, you have to get married before your green card gets approved. Otherwise, it will be a big headache for your spouse to come to US. Again, it depends on your country of birth and PD.
