  • H-1 stamp and H-4 issue

    Good morning Friends:

    I need your guidance very urgently. I have changed my employer “A” to “B”. I have visa stamped for my previous employer “A” which is valid till 2010. I have also received a new I-797A along with new I-94 (the new I-94 has the same # as the previous one but belongs to my new employer “B” and have expiry date of 2011). Although, my company lawyer has advised me to go for the Visa stamp for the new employer “B” in July when I am going for the marriage, I come to know that this is not necessary as I have gone through so many threads over here. However I have only two questions:

    1. Can anyone help me find out any legal documents which confirms above rule?
    2. Will my wife have any problem to get her H-4 if I don’t have my visa stamped for the new employer “B”?

    Guys, please give me your comments/ share your experience. My company attorney is really rude. Don’t want to contact him again. Truly appreciate your time and help.

    1. You are going to have to trust what you read because it's correct. A visa is an entry document and can be used with any employer who you have an approved H1 for regardless of what the visa stamp has as the employer.

    2. Should not be a problem.

    You can find the sources yourself and you, in doing so, will learn a lot.

      Thanks DMX! truly appreciate this! I was expecting the answers from you and txh1b and other members. I found somtehing called AC21 june memo. Howvere, that is for 2001 and was not able to find abything else afterwards. I am not sure that document is still valid or not? also was not sure any rule changed this year or not? Do I have right document?

        It was issued in a memo HQPGM 70/6.2.8 (Jun 19, 2001). Feel free to look it up under press releases section of USCIS website.

        The AC21 travel memo from 2001 still stands good and is valid. Nothing has changed since then. Attorneys and even consulates ask you to apply for a new visa, but it is NOT needed. People have been using their valid visas for past 7 years for re-entry without a problem. You just have to trust.

          Also in that memo it says that "The nonimmigrant applicant is admissible to the validity date of the previously approved petition, plus 10 days." Shouldn't I expect new I-94 with exp date of my new petition? Thanks!

            By all means, the I-94 will be issued as per the date of expiration of the new I797.

            What you are reading is for someone that travels without a new approval notice.

                Are you also a renegade from the other forum that we used to hang out in earlier? There is no way for me to have helped on this forum for your OPT as I recently started out here.

                  I am not using that website any more after insulted by a few folks who believed only they only know the stuff even that is wrong. Anyways, I have found this new documents

                      That is an official document released under Freedom of Information act and is authentic. What are you trying to do? Educate yourself more about this or find an official source for AC21 travel to carry a printout with you in case of trouble at POE?

                      It has been tried and tested and there is no point in worrying over something as simple as the issue in this thread.
