Changing job while in H1 Extn

Hi,

Please any one throw pointers.
I am on my H1B 3 years over and It is expiring in few days.
The extension has been filed by my current company "X" and the status is in initiated stage.
Now i have an offer from "Y" company.
CAn i join that company?Will there be any problems?

2 cases:

1. Current I-94 expired:

If current I-94 has expired and current company has filed for extension before the expiration of the I-94, you could work for that company for 240 days. Company B applies for a transfer using company A's expired I-94, pending receipt.

It is risky to use AC21 in such a case. It is rather good if one applies for a PP transfer and join the company only after the transfer is approved.

2. Current I-94 still valid:

Same as above. But in such a case, you are safe to start work for new company using AC21 upon filing of the petition.
