  • H1 to F1

    Hello,

I came to US on my F1 visa and then after my graduation I had H1 visa. Now, my H1 visa is about to expire in Oct 2009. I believe after 6 years I have to go outside US and I can re apply back again after an year. But instead of that, will it be possible to convert from H1 visa to F1 visa again ( as I am planning to go for a grad school -MBA ) and then complete my MBA and reapply for my H1 visa.
Please let me know, in that case I assume I dont have to go back?

    Thanks
    Sachin

The 1 year has to be spent outside the US but not on a different staus while remaining in the US. You can also get renewals past 6 years if you have a pending labor that was applied 365 days before your H1b 6 year completion.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
