  • H4 Visa for Wife and Son

    Hi,
    I have changed my status from L1 to H1 last year. I don't have H1 visa yet coz I did not go out of country. My I-94 is valid till Sep 2010.
    My wife and son has to go for H4 visa stamping at Chennai. Do I need to send an invitation letter and also a letter to consulate?
    If so, what is the duration of stay that I should mention in the invitaiton letter and letter to consulate? Should I mention the I-94 valid date?
    Do I need to send I-134 also? If yes, then should I send affidavits for both of them?

    Appreciate the help.

    Where did you come up with all that list about invitation letter for a H4?

    Are they currently in US?

      They are not currently in US. They are in India. I got the information from my friend, his wife's visa was not given, she was told to get invitation letter.

        I am guessing they asked for the letter from your employer asking for a H4 for your spouse. Invitation letter for a H4 is unheard of, at least by me.

        The documents from https://www.immihelp.com/usa-h1-visa/ should be enough.

          Thanks for the info.
          Do I need to send my original I797, I129?
          I don't have a visa yet, would that be a problem?

            You need not have a H1b visa stamp for your dependents to come to US. They need your original I797, certified I129 from the attorney. Original I129 will be with USCIS.

              I changed my status from L1 to H1 so I will not have a visa. Is it mandatory that I should get H1B stamping done before my wife & son go for H4?
