H1b visa + no pay (bench) is legal?

A company sponsored H1 visa to my wife who was on H4. She never got paid as she was on bench.

My attorney, when I went to her to extend my H1 visa said that "Staying without pay on H1 visa is illegal". Is this true? to what extent? any exceptions?
