employer change

Hi,

I came to US mid of 2007 with an employer ( H1B - Stamped and valid till SEP-2009 ) . After coming to in US, I left the company and joined another company .. now the new comapny has handed over my I-797 , I-797 shows my visa is valied till SEP-2010.

My passport have got visa stamped for my previous employer ( employer name and validity till Sep 2009 ) is written .

So far , I have not left the country but this year end i am planning to visit india , do I need to appear again for stamping in india before coming to US for my new employer ?

My current employer says - not required -- just carry employement letter and approved I-797 where validity is till 2010 Sep.

I left the previous company with out telling as they were unable to put me in project ... can they put any bad comment about me at UCSIC. I dont owe anything from them.. they even not given salary to me for 2 months.



Please advice.

Did you get a new I-94 with the approval I797 from the new company?

How did you transfer without paychecks/project from the old company?

1. My I-94 is with my passport which I got while entering to US in POE . Thats the only I-94 i have.

2. My current employer able make it with the help of bank statement , as my previous employer deposited few amount in cheque .

If what you say in 1 is true, you are screwed big time. Is your approval I797A or I797B? Did you ever get to look at it? Check if it has an attached I-94 (not white in color) at the bottom.

If not, you are out of status and have worked illegally for employer B.

I-797A comes with an I-94. That means that Change of Status OR Extension of Status is also approved. The new I-94 determines the date you can legally work in the U.S.

I-797B does not come with an I-94.

what is the meaning of I797 C

C is just a receipt. Doesn't mean much other than your application has been accepted.

I checked my doc... My new employer first given me I797C .. then upon approve within a month, he has given me I797A and in lower portion I-94 is also attached with some number... its not in white paper , its in printed paper of I797A...

You are good to go. Remove the printed I-94 and staple it to your white I-94.

Not as long as the visa is unexpired at the time you enter the U.S. A visa is just a visa and it can be used for any employer.
