H1 w/o Pay wanting to switch to H4

My wife has been H1 w/o pay for no 3 mths. I want to do her h4. Comapay is giving Leave w/o pay letter for the duration.
ImmiHelp what do u forsee as a problem in getting her h4.
Would this jeorpadise me getting my GC. Is she out of status
just bcos co is in bad times and not paying her (she is on bench).
Will appreciate help from Immihelp.
