H1B and EAD

Unfortunately my H1B wasn't selected this year. My husband is planning to file I485 for both of us so that I can have a valid EAD for my work. I was wondering if I still can apply for next year's H1B. My husband's I140 has not been approved yet. I am worried that if his I-140 is denied then I will lose my status very quickly. My company does have oversea offices. If I can get a L visa, can I still apply for H1B next year? Thanks a lot!

What is the PD of your husband's GC?

Are you currently outside US?

If you qualify for a L1, you can come on L1 and later switch to H1b if you get through the lottery. Read through the forum for many such threads and the procedure to familiarize yourself.
