ok, I will try to get second opinion from a lawyer. Meanwhile will the immigration officer give any useful information when we meet on Tuesday. what kind of help do they provide?

An update.
We went to the INS office in San Jose and the lady there was of absolutely no help. She checked the status of the H1 and said it is approved still and she asked us to check back in 3 months.
She showed me some other card that she had(I think GC related) and she showed that for Advanced Degree holders from India, the date is April 2004, not sure what she meant.
We realized that she did not know anything and we walked out of there.
