H1B Visa Validity

Hi Team,

Case: An applicant has a valid H1B visa till 2009 from a company he is not working anymore. If his current organization wants to apply a B1 Visa. Does his H1 become invalid if he gets his B1?

His H1 status is not valid anyway because he does not work for that company anyone.
