L1 To H1 with COS- Urgent help Needed

Hi.
I'm working for company A on L1 visa which is valid till 2010. Mean while I
got my H1 COS approved by company B. But I want to join Company B after dec 08.

1. So can I do that? If Yes then how...as H1 will starts from oct08

2. My wife is with me on L2(dependent visa). she is goin back to India and
will come back by march 09 ... at that time I"ll be on H1. so on what visa she
can come to USA?

1. As it is a COS, you have no choice. You have to start on H1b from Oct 1st or be out of status. Look at other posts for work arounds.
2. Depends on what status you are at that time. The spouse has to enter on the respective visa.

1. what happend If I"ll continue on L1 status till dec 08 end and will join company B in Jan09?Is it illegal...

2. If I go to India in Sep 08 and then stamped my passport and come to usa in jan 09?

Whats better way If I want to join in jan09.?

1. Illegal to continue on L1 past Oct 1st. Look at the forum for answers. Search for leapfrog.
2. If you want to stay out till Jan 09, you can do that or re-enter after Oct 1st again on L1.
