Hi.,
I got "company A" visa stamped in India which expires in Nov'25 2000, after coming to US I changed to "company B" where I got new H1 valid up to 2003. But my wife attended the consulate for H4 in India with my old H1 only(at that time my new H1 is not approved), and her visa and I-94 expires in Nov'25 2000.
So what i need to do now?
1.Shall she go to India and get H4 stamping.
2.Shall she go to Mexico for H4 stamping.(She get stamping and I-94 up to 2003 in Mexico)
3.Shall she apply I-539 (but i heard that it will take one year to get extension)
4.What happens if her extension not get before Nov'2000, does her stay in US becomes illegal.
Please give me guidance in this regard.
