    Hello,

    Could you tell me in details, what should a person look for when he joins a consulting agency in the USA on h1B visa ?
    I need this information on the following points:

    a) Dos and Donts before starting work
    b) Sign an agreement / contract paper
    c) facilities
    d) Misc.

      This is a loaded question and has much to do with personal choice and hence I chose the golden silence. Ask specific question and I will try to help. Open questions are hard to answer.

      For some medical benefits might be a must have and for others a 85-15 profit sharing will work fine.

        Yes, my question was quite generic. I heard many consultants :

        a) ask for signing a contract for 6 months to 1 year.
        b) They do not pay on time when a person is on project and also do not pay when they are on bench.
        c) They tell that they will process Green card but do not do so
        d) They do not give proper pay stubs
        e) They do not pay for the medical insurance even though they commit.

        What should a person look for before he joins the consultant as an employee (after H1B is approved) ?

        Also, I would like to know if the consultant is not giving I727 to the employee, what should one do ?

          a. Can do that and claim liquidated damages. Your choice.
          b. Complain to DOL on a WH4 form. Search for rights from the Neufield memo on the forum.
          c. Again, you are the best judge. If they don't want to, you cannot force but can find a new employer and move on.
          d. Again, complain. Insurance costs are between you and employer and it depends on what is provided to other Americans, that has to be provided to you.
          e. Complain or move to FT job.

          If you are outside US, thay have to give I797 for stamping.

          Consulting world is full of smalltime scumbag employers. Find a FT job and move on once the initial period is over with these scumbags.
