I have an unusual case, and would like to understand my options at this point.
The scenario:
I am in OPT until the end of December for my US Masters Degree (non STEM). My former employer applied for the H1B for 2009 fiscal year, and my case got approved under the Masters quota. My change of status was also apporved.
The problem/ question:
As I am no longer working with the company that got me the H1b that would have started on coming October 1st:
1) what happens to my H1B cap? Am I cap expempt? Can another employer file for my H1-B, not having to wait until next April?
2) f H1B is totally lost, can I still have my OPT valid until December?
Please let me know
