  • File h1b xfer when one is alreay pending & services with the old compnay are defunct.

I am on h1b visa. I transferred my h1b from company A to company B. I received the EAC number & then I joined company B even though the case was pending. Its now 2 mths & I have 2 pay stubs from company B.
Now I do NOT have I-797 on the name of company B , but I want to switch to company C.

Can I do this? if yes , how? Which docs should I give to company C for h1b transfer (I do not have I-797 from company B. I do have one from company A, but I have resigned that company 2 mths before). Please guide me on this.

Look through similar posts on the forum.

If your I-94 is valid, you can apply for a transfer using I797 from A, receipt from B, paystubs from B and the rest of H1b docs as usual.

There are associated risks of B's transfer gets denied before C's gets approved and your I-94 expires and hence you should talk to a lawyer. Better go for PP on C's transfer.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
