  • After 6 years of H1

    Hi
my HI visa would expire on 2009(6 years ) and i did file for my GC and now 1-140 and 1485 are pending for approval. My question is
1-when i file for my extension next year ,if it failed do i have any other option like applying for F1 visa for my masters or any kind of other visas.
My wife has GC and she got it before our marriage through employer.
Please let me know what are the other possibilities to stay legaly in us.
    thanks and appreciated

If you have a pending 485, if H1 extension fails, you can work on EAD. No F1 allowed as you have expressed immigrant intent. The fact that you are married to a GC holder is a bigger issue for F1.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

But my EAD will expire on this nov.2008 and my H1 will expire on next year march.
can i extend my EAD ?
My 1-140 is also pending as like I 485 and still i would be able to work on My EAD(IF IT GET EXTENDED) even if my H1 extension FAIL.
      Thanks and appreciate your help.

EAD can be extended as long as I-485 is pending.
