Working on L1 and Got H1 Approved..

Hi txh1b/Senior members.
I am currently working on L1 and wife is working on L2 EAD.
We both applied for h1 and my wife got H1 approval already.
I am still waiting for my h1 Approval.

Here is two situations..
1) What if my H1 is pending approval and my L1 project is over.What options do we have at this point?

Assuming both our H1's aprroved, what happens if my L1 project is over before OCT 1st,2008.

2) Do we need to leave USA and come back after oct1st once H1 kicks in?
3) Is there any way to stay back in USA based on the H1 Approval
Any suggestions in this regard is appriciated.

1. L1 status ends before Oct 1st, you should leave immediately and come back later on H1 with a H1b stamp. The approval, if a COS was granted based on the assumption that L1/L2 remain valid until Oct 1st.

3. You could try COS to B2 but that is risky as if denied, you would have accumulated illegal presence. Not a good idea.

I also have the Same Problem...

Presently i am working on L1 for Company A. And i am waiting for H1 B Approval form Company B.
(They asked me my Paystubs ,W2 forms and also Tax Proofs)

My Project in Company A will be for Next 8 months.

If my H1 B is Approved (Wth Change of Status)
Do i need to shift to Company B Immediately
If my H1 B is Approved (Wth OUT Change of Status)
Do i need to shift to Company B Immediately
Coz in the Present Project i am learning more and want to be till its Implementation..

Can any one of u suggest me what can i do not / what i need to do ..

Yes. You have to work with H1B employer from Oct 1st onwards.
