  • H-4 to H-1B 1st Time stamping

I came to US on H-4 and successfully got my H-1 B approval as of Oct 1st 2007. I need to stamp my visa for the 1st time. I know the ideal place would be home country but as of now I wont get a leave for more than a week. I also need to visit INdia in Jan for a wedding . I can make a trip for utmost 10 days. I dont think the entire stamping process can be completed in 10 days. I want to look at Mexico & Canada as other options.

I have a MBA from India with 2 yrs work ex in India and close to 1 here. Does going to canada or Mexico an extremely risky choice? Kindly guide.

    P.s: Mine is a Change of status ( I Have a I-797 A with a I-94 attached to it)

Any third country stamping has an associated risk and many people take it for a successful stamping.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

If education is not from US then there is a slightly higher chance of you being redirected to your home country.

But why do you want to stamp your visa now, in the first place? Cant you do it in your planned JAN09 visit to India? I dont think your I-94 is expiring since you a new I-94 last year only, should be valid for 2 more years now.
