Valid H1B Visa, but I-94 expires due to passport expire

Hi Friends,

I have valid H1B visa till December 2009.
I-94 will expire in October 2008, since my passport expires in October 2008.
Now I have my new passport.

Is it good to stay till December 2009 (after expiration of I-94) or what options I have to get new/ updated I-94.

Appriciate if u share u r experience on this..

No. You must NOT stay or work past the I-94 date. You need to apply for a renewal of H1b or travel and get a new I-94. As an alternative, you could go to CBP and see if they will correct the I-94.
