urgent please help(can i get a duplicate I797)

hai

have gone for h1b in toronto on sep 2nd ,the visa officer did not ask any questions except what is y'r employers name and what is y'r position.

she gave me a 221g and also kept my 797 form with here.

want to ask if i can get a duplicate 797 and apply for visa at a later period .
or
is my case dead.
am not able to console myself ,have been trying for h1b since 2006 and finally got in the lottery this year.

please kindly post me any advises

Can you explain what VO gave you in 221g, or what VO told you. any hint? or why they kept your 797?

the vo said nothing
gave the form saying prospective immigrant 214(b)
when my lawyer contacted the vo saying the 214(b) prospective immigrant is not applicable for h1b
the vo relied saying it was a 221(g) and was a mistake that the vo gave a 214(b).
she said she was not able to evaluate my B.E degree ,which she din't even take a look at.

any suggestions of what can be done further please help

The 221g is not a denial.

It is recommended that one attend for interview in home country if applicant does not have US degree.

You have a lawyer working on the problem. Ask if you have been redirected to apply at the consulate serving your home.
