H1B Visa - Working on 1099

To whom it may concern:

I am an employer who is not sponsoring an H1B employee, but we have contracting opportunities available and an H1B employee working for their sponsor approached us to do 1099 work on the side. Is that allowed?

He can work for you only if you sponsor his H1B (full time or part time).
