    Hi All
    I came to US on H4 and my visa has expired but i have a valid I-94 for 1year.My Husband's labor is cleared and I-140 is filed with Employer A.
    I got my H1 approval for 2008 with employer B.my Questions are:

    1. I want to go to stamping for my H1 along with my daughter as i have to visit India during march.If I do so the employer details on I-94 will be changed,Should my husband inform his employer regarding the changes in I-94?
    2.Can i change my status now or is it best to be on H4 until I-485 is filed?

    Please advice me.

    1. No. Your husband's employer has nothing to do with the H1b status or yours. They should no longer try to extend your H4 status which does not matter as your I-94 would have changed.

    2. On H1b, you should be working and get paid all the time. Just getting a H1b stamp without working is a problem as it is illegal and will put you out of status.
