  • L1 to H1-Change of I94

Im currently on my L1 Blanket and also have my got my
    H1B visa approved
through change of status with I94 this year i.e Apr 2008 by
    some other employer.

My L1 individual visa was getting expired on 15th Sept
    2008,so i went back
to India in Jul 2008 and got a L1 Blanket visa
    stamped.
Now what i understand is that i either go to Canada/Mexico and get my H1B

stamped OR apply for an amendment of I94.
Which one would be a good option? Can i join the other employer on my H1b after

1st Oct 2008 and then get the visa stamped/amended?How long would the

    amendment take?

    Thanks in advance.

You cannot join the H1b employer until the COS is approved and once approved you can no longer work on L1. As far as third country stamping goes, if you don't have a US degree, it is a risk that you could be directed to your home consulate which many people take for successful stamping.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

We need to join new employer immediately when H1 is approved. I've read and heard that it's Oct 01 ? Isn't it ?
