Can I go to India and get H4 Stamped while having H1B approval

Hi Friends,

I have few questions.

I got H1B approval notice, valid from October 1st 2008. My employer not yet given me H1B Docs. Now i am in USA with H4 extension approval. I am planning to go to india in Sep last week or Oct 1 st week.

1. Can I go to India and get H4 Stamped over there after Oct 1st and come back to USA

2. Can I use approved H1B once I came back to USA

3. I heard that we can convert from H4 to H1 what is the procedure for that and Normally how long it will take converting from H4 to H1.

4. In that case how to get SSN

Was your H1b approval a COS from your H4? If so, you need to leave before Oct 1st or start working on H1b from Oct 1st. No exceptions!

1. yes
2. Not to work before an amendment to change your status to H1b is approved by USCIS.
3. Look on the forum. Many posts on the same subject.
4. Wait till COS is approved for SSN.

No risk involved for COS. The worst thing that can happen is requiring one to go for stamping if a COS is denied.
