Travel during H4 Extension

Hi,

My current h1 exipres on Oct 1st. I have filed for premium h1 Extension. My wife and kid are in India. Is there any risk in them traveling before oct 1st as there will be only few days left before expiry?

Please help.

There is risk as their I-94 will be issued only until Oct 1st and you have to file for renewal of H4s immediately upon arrival. In my view, it is waste of money.

Instead, they could wait till your H1b gets approved and travel with the new I797 approval notice.
