  • Joining back to previous employer - Previous H1B still valid or not

    Hi,
    I am going to leave my current employer 'C' company and switch back to the previous employer 'P' company ASAP. Here is the issue that I want to know;

    'P' company applied for H-1B for me and got approval. Later on , I asked 'C' company to file H-1B transfer, which was approved as well. So I moved to 'C' company after the new H-1B got effective, but after some time due to market situation they have sent me the termination letter with the condition of H1B will also be Revoke. Now I want to join again my 'P' company.

    1) Do I have to file H1 transfer again?
    2) Will it be legal to work with P company with out the H1B tranfer?
    3) What is the time limit to get the transfer of H1B as my C company has revoked my H1B?

    I'm really confused because I assume that since H-1B is based on employment, it is automatically terminated when I left the employer, i.e. I need to re-transfer it from 'C' to 'P'.

    You can join them immediately if their petition is valid and they did not revoke it. A consultation with a immigration lawyer will clear it all for you and it is worth the money.
