  • L1/L2 to H1

My husband is on L1 visa and I am on L2 visa. I have worked on L2 visa from June '07 to Dec '07 and went to INDIA as my husband's company required us to go and came back in May '08. I have again started working from July'08 to till date.
    I have the below questions:
    1. As we were in INDIA when we applied for H1 in April '08, I was told by my employer that we have to go out of country (USA) and get my visa stamped for my H1 to be effective.
    2. Do we have any timeline by which we have to convert to H1?
    3. As I am working as 1099 contractor, I am not given any payslips (paystubs) by my vendor. Will I need the payslips (paystubs when i go for my H1-B stamping) to go for H1 Visa
    4. As a 1099 contractor my company does not file taxes for me. DO i have to file my taxes it monthly or quarterly or at the end of financial year
    5. What are all the documents I would need for H1 visa stamping. We are planning to go to Mexico for the Visa.

    Please anwer my questions above.

    Thanks

    1. You can either get a stamp or the employer can file for an amendment.
    2. No
    3. Not really. L2 is optional work. As long as you are filing taxes for the money you earn.
    4. Yes, you better do that or you will be hit with a hefty underpayment penalty.
    5. Same as any other person would do.
