    Hi,
    Good Morning to All

    I would like to know is it mandatory I797 approval notice for H4 stamping?Can't go with I797 receipt?

    My wife is going to chennai for H4 stamping .Recently I moved to new company in U.S and they transferred my I797 to them ,at present I have only I797 receipt from this new company.To get approval it may take some more months.

    Can I send the latest I797 receipt and my old I797 approval Notice for H4 stamping along with all the required docs?

    Please do let me know your valuable suggestion ASAP.

    Possible but she should be able to explain clearly about the situation. A letter from the attorney would help as well.

    Most people choose to wait to avoid unnecessary complications or premium process the transfer by paying $1000.

      Hi,

      As per the requirements - I797 Original (Delhi , Kolkata) and I-797 Photocopy or Original (Chennai) is required/mandatory.

      Now for stamping - everything depends on VO - he/she may verify your I-797 using PIMS and the I-797 Receipt which you have and may give H4 to ur wife.

      Please note that I am assuming that your I-797 is approved and you don;t have a copy of it.

      r u saying that it is not even approved yet?

      If it is the second case - then it is a risk you are taking- as receipt does not implies that ur I-797 is approved or going to be approved.

        Hi,

        As correctly mentioned by txh1b - please do the premium processing which I think will take 15-20 days for the processing.
        and then you can ask ur wife to go for H4 stamping.

        Otherwise - all depends on VO - even ur wife explains everything/situation- and VO may put it on hold on the basis that ur I-797 is not approved yet.
