H-1 to H-4 : Help needed

Dear All,

I am on a H-1 B visa and wish to convert to H-4 for personal reasons. I know you can do that by filing Change of status within USA or go to home couuntry and get H-4 stamping.

My question is if i Need to re-apply for H-1 B do i have to wait for April to apply in the regular quota or is the process any different the 2nd time. I have heard that the new company can re-apply for change of status to H-1 B at any time and not wait for the April every year. Is this true?

Once you have been cap counted, the April date is not of any importance to you. Read the FAQs.
