Issues on H4 to H1

Hi,

I came to US on h4 visa and got H1 approved this year,i have few questions

1) Will my status change to H1 automatically once H1 was approved, or should me or my employeer need to apply for the status change ?

I am not working now and planning to goto India on december 2008 and will go for stamping in India,

2) will there be a issue, since I don’t have any pay stub to show in the consulate?
3) what can be possible excuse ? will medical reason can be an excuse?

If your H1 was approved with a Change of Status starting on Oct 1st and you are not working, you are out of status. This can cause problems.

Please do not ask the forum members for the best excuse i.e the best lie.
