f1- h1 , travel and COS, I-94 qs

Hi all,

This is for my friend. He has his H1 approved in PP starting Oct 1, 2008 , with a COS from f1. He has been working with the same company in OPT and Now on h1.
He traveled to India in Aug 08 and was back in Sep 08. When he came back to the US , he got a new I-94 with F1 stamp on it.But his H1 approval has the old I-94 number. Should he do anything about this .

1)Did his COS get voided?
2)Should he change his I-94?

Please advise.

1. Efren Hernandez memo allows this without voiding the COS.
2. He needs to go to USCIS local office or CBP and they will give a corrected I-94 to show H1b status as per reports from the forum members.
