  • L1 to H1 COS -- Update requested AFTER 1st OCT for people still in L1

    Hello

I am not going to ask the usual questions about what will happen if i continue in L1b after Oct 1. 2008. This Question has been answered 1000 times and still daily i see the same question asked in different manner.

I need to know the following.

    Q. After this Oct 1, 2008, did anyone on this forum did a Leap frog from going to Canada, Mexico, India. Please share me your experience, i need to know from the people who did this Leap frog after Oct 1,2008 like sometime in Oct 10, someone went to canada and came in on Oct 12.

How was their experience when they came in front of the border officer?.

Was the border office able to find that the person had a active h1b status, or did he simply did not bother and let them come in.

    Question 2.
This is different manner. I am 100% sure, there are many people in this forum who are in H1b but still working for their L1 employer or there were people who worked for their L1 employer last year while their H1 was active.

Everyone says it is illigal to work, i agree.. but did anyone had any issue with respect to this. Did you have any queries while your tax was filed. or Did USCIS queried your L1b employer about your status.

Please share your experience, any input this above question will be appreciated.

I will be really grateful, if there is a response on this question

It is not USCIS's job to go around looking for violators. If you run into some trouble, then all hell breaks loose if one violates the status.

Every violation can be held against you if one does not declare in in the visa form in the future and also during the residency purposes.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

If you have continued to work in L1 status after the start date of a COS H1B, you are working illegally. This is one action that the USCIS takes seriously. You need to stop working for your L1 employer immediately.

Since you want to debate the fact that others may have worked illegally, get a lawyer and have him/her explain it to you.
