Problem with payment

I am writing this query for my friend. He just transfer his h1 this month. i.e. His new H1 start from Oct only. Still he didn't get his pay from his old employer for the month of September. As per I heard, he can take legal action to the old employer because they didn't pay him for the month of September. If yes then how?
