  • Pay without SSN

    I was on H4 till Sep 30, 2008. I am on H1B from Oct 1. I am working for Consultants. Work supposed to start on Oct 01. But my actual work started on Oct 07. I didn't apply for SSN as employer didn't give me the I-797A, Notice of Action (Approval notice) when I requested. (I have a copy though). I got my first pay check without SSN. I think thats what going to happen in future too.

    1) Can I get paid without SSN? Is it legal?
    2) Is there any way I can get the Original copy of I-797A from the USCIS?
    3) Is there any way I can apply for SSN without I-797A just showing my paycheck, employer offer letter etc.,?

    Anyone's help would be highly appreciated.

    Did your check have SS and Medicare taxes withheld? Monitor you checks to make sure that they show the proper YTD contributions; check the W2 you will receive in January. This is when the SSN is critical. Working before you receive the SSN card is fine.

    Take what paperwork you do have to the local office and apply. If you absolutely must have the original for them, you can use this to get the original from your employer.

    If you have problems with your employer, get an attorney to advise you. A letter from him/her will generally solve many little problems.

      1. It is possible but should not be for a long time. You should have proof that you have applied for SSN.
      2. Your employer SHOULD give you that. You cannot continue to get paid without SSN. USCIS will not give it to you.
      3. You just need the H1b I-94 from the I797A to apply for SSN. The I-94 is a document that belongs to you. If the employer is not ready to give you that, you have to follow the compliant procedure.
