Urgent plzzz: Husband Pay stubs are really required for wife's COS

Hai All,
plz answer:
I am on H1.
My wife has got her H1 in consular processing.Now she is also here only(US).
Now she is on H4 and she wants to file for Change Of Status(COS).
the problem is : Attorney is asking for my paystubs to file the COS.Right now i am on bench and i donot have any paystubs. I would like to know if my paystubs are really required to file COS to my wife.Can i proceed to file COS for my wife with out my pay stubs??
plz suggest me....thank you....

Your status is the key to H4 status validity. You being out of status makes the H4 out of status as well. Benching without pay is illegal.

Attorney is right and you need to get paid, project or not. That is the law!
