Another H1B Petition

Hi everyone,

I have been filed by a cap employer for H1b last April, 2008 but I am still awaiting for the result due to RFE.

Is it legal for another agency to file for me under H1B cap exempt considering that I have a previous H1B petition and it is still on going?

ask your employere to submit necessory docs at USCIS.. at a time you can apply for any numbers of employer under H1B cap from different US state. but you must have to apply for visa with one employer's I-797B, there is doent matter that 1 is RFE and you selected by another employer.. I selected by 2 employers and (1RFE with 3rd employer)and at last I choose one final employer and applied for visa..
