H1B Visa Travel -- Urgent help reqd

Hi:

I am a Post Doc at an Univ in US. My current H1B is valid till Dec 31st 2009, but I don't have a stamp. I have to go to India for my sister's wedding in November and I will be back on Dec 4th. I was planning to get my visa stamped with the current H1B.

I have a job as a Professor starting Jan 1 2009. The Univ has already applied for my new H1B, but the application is pending.

I know it is not advised to travel under these circumstances --- but has anyone done that? And what are the possible consequences? Is there some precautions/measures I can/should take?

You should not travel. You have to wait till the H1b gets approved before you return. I suggest you get it done as a premium case by shelling out $1000 if you MUST travel and return with your new I797 approval.
