Will a new I-129 fall out of H-1B Quota?

I am in US on H-1B. My Extension of Stay(I-129) is pending with USCIS from more than 9 months. My 240 days period for authorized work is ending in November-end. So, am leaving US before that.

I have a question for knowledgeable folks here:

If my EOS application is subsequently denied by USCIS (while am out of US), and if my current company files a new I-129 application -
will it fall in next year H-1B quota?

If any other company applies a new I-129, will it fall in next year H-1B quota?

Depends on if you completed 6 years or not. Read the faqs or search for "remainder" on the forum. If you have H1b time left, you are already cap counted.
