  • Gap after H1 activation...

    Dear Frnds,

    I graduated in Apr'08 and got my OPT in July'08
    I filed for H1 this year and it got approved and I believe my status changed to H1 on October 1, 2008
    I was looking for a project and got it in November'08.
    Now the Employer made me sign a pre dated leave appln from Oct 1st to my start date of project saying that I would be joining late due to some personal concerns...
    I did not have a choice as I had too little time ....

    Would that kind of leave appln have any impact on my H1 stamping or GC in the future?

    The employer is legally bound to pay you in the period and is protecting his own interest by making you do so and you are hurting yourself by doing so.

    It is illegal to force or coerce someone to sign a LOA. Find a good employer and switch. You can complain to DOL at that time.

    You have hurt yourself by signing something like that.

      Firstly Thanks you so much for the reply....
      "Hurt myself"...does that mean that it might have some future repercussions? could you kindly be a little descriptive about what issues I might have and when and how serious they could be?
