  • Need Clarification on holding H1 and L1

    Hi,

Currently I am working for a comapany A and I am holding a valid L1B visa for the same company A. But I have not travelled to US till now on L1. Also I have applied for H1B through company B this year. I got workpermit approval for the same. If I attend the H1 Visa interview and get my H1 stamping, will the L1 visa goes to void. Is there anyway to hold both the visas active.

Depends on the VO. As both are work visas, the VO may choose to cancel one of it. You are telling the VO that you have a H1b job waiting for you in the US to get the visa stamp. Makes sense?

when you go to stamp your H1, the important thing the VO will see is the H1 Petition. The employer name is written on your H1 petition and your Visa on passport (The consulate might have record of your L1 Visa also, but he doesnt care, he will only look at the Petition and stamp the correct Visa).

Once you get approval, you will resign your old company to come here on H1.
Then the old company will call the consulate and cancel your L1 Visa. (Generally L1 Petitions are Blanket and valid indefinitely ) so petition will not have your name on it as H1 does.

      Hope this helps.
      Thanks

No company can cancel a "visa". It is the petition they can choose to withdraw.
