  • H1 to H4 transfer

    Hi,

My wife is currently in H1 and since she is pregnant she is planning to take a break for 6 months.

1.I would like to know if it is possible to tranfer the status back to H4 from her existing H1.
2.If yes, should we contact our employer and ask them to do the transfer.
    3. What would happen to the existing SSN number because in H4 we are not eligable for an SSN. Would her credit history be affected because of this?
4.Is it easy to switch back to H1 when she wants to take up a job.

    Thanks,

    1. Possible if she is currently maintaining a valid status and getting paid and working.
    2. There is no transfer. A COS form I-539 has to be filed and the individual has to do it. Employer does not in this case as they have nothing to do with the H4.
    3. SSN remains the same. Nothing happens to credit history if you dont work. If you don't pay your bills, that is when it goes bad.
    4. Yes.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
