  • H1b Visa Transfer (outside USA)

    Hello,

My H1b visa was issued on May 2007 (which is valid till Oct 2009). I went to USA on a 3 month contract job in August 2008. Immigration people asked me alot of questions for coming so late but finally they let me enter USA after seeing my contract papers and letters from my company.
I left USA after finishing my contract (first week of Nov 2008). Now I got offer from another company which is ready to transfer my H1b visa but after my arrival in US. They want me to fly back to USA asap.

    My Questions are:

    1. Do I need to inform my original company who sponsored my H1b visa about this new offer?
    2. What type of question I should expect from immigration people?
    3. Do I need any fresh letter of Invitation from my original company?

    Regards,
    Fazal Khan

    1. No
    2. Your new employer should file for a H1b and after you get the approval, then only you should travel to US. If not, it is fraud.
    3. Yes. A H1b approval or I797 is a must.
