L1 / H1 Help needed - Urgent

Iam on L1B visa working in the US. While in the Us, my passport (all pages including visa) got damaged and I got a
new duplicate passport from the Indian consulate in the US.
Now if I apply for H1 (COS) and my H1 is approved and then I travel to India say on Sept 1st for the H1 interview
and unfortunately my H1 is rejected in the interview.

1. Will I be able to apply for L1B restamping on my new passport
and travel back to the US on L1B after Oct 1st (Leap Frog)?

2. If I do the Leap Frog, will I be able be work for the H1B employer while in the US?

Your timely help is much appreciated.

Yes and No(The H1b employer has to file an amendment if you want to work for them if you enter on L1) as long as L1 petition and job are valid.
