H1B Expired,I94 is expiring,no update on Extension

Hi,

My H1B visa expired on Dec7,2008. My I94 is also expiring on Dec17,2008.
I have filed for extension, but I didnt get the receipt number yet.

I am travelling to India on Dec19,2008.

Can I travel on Dec19 without any legal status or should I travel max by Dec17th ? Will the ariport people ask for evidence or proof when I depart?

If your current status of ...

... stay in this country, by I94 or H1B approved petition is until 17 December, then you need to leave the country by this period.

Do note that you will not be able to re-enter until you get an approved petition with which you apply for a visa that's stamped on your passport.
