  • H1B revokation and transfer question

    Hi,
    My ex-employer will notify USCIS about my job termination on Jan 6th 2009, ie. my H1B will get revoked any time after Jan 6th.

    I have found a new employer but it might take about 15-20 days post Jan 6th for my new employer to file for a transfer.

    Is this gap , a cause for concern?

    As long as the transfer papers ...

    ... have been already filed and you have the receipt for the transfer, you should be able to "squeeze" in.

      From your experience, how many days past Jan 6th would be a safe estimate to still "squeeze" in?

      (Trying to gauge my safety net without pushing the envelope both legally and practically)

        "Technicall" ...

        ... once you're out of status, you're out of status and cannot stay & work in United States.
