L1 + H1 total years spl case

Hi

I am on L1 from company A for the last 3 yrs and going to India in Feb 2009. Company B is ready to apply for H1. If I get thru the lottery in April 2009 and if I get the stamping after Feb 2010 (i.e after 1 year staying in india) will I be eligible for 6 yrs for that H1? Or is it like I have to wait for 1 yr before I could even apply for an H1 ?
