  • H1 withdrawal

    Hello,

Will it create a problem if someone decides to withdraw H1 by not replying to the RFE ?

    Thanks.

Problem for what, who? Provide details.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

      Sorry for not being clear.

If someone who has applied for H1 in the US soil, if the employer gets RFE for not mentioning projects, no proper pay stubs etc and now the employee has to produce some docs. If he cannot produce docs like pay stubs for replying to the RFE on time, what action can the USCIS take ?

Also, will it impact the current L1 visa that the same person is working for ?

If the future employee is in valid status in US, what is the reason for not being able to produce the needed pay stubs? USCIS wants to ensure that you are holding valid status in US before they can approve any petitions.

Not doing so will harm your case but will not have any impact on the current status if being held properly. If there is a violation, USCIS could potentially inform ICE for deportation which generally does not happen unless the status violation is proven.

It seems to me, OP did leap-frog to avoid COS and intentionally don't want to reply RFE on H1B petition (by not producing documents) so that H1B wont get approved.

In that case current status will not have any impact and you can continue on L1 also your h1 employer will get denial notice for not replying RFE.
