    Hi Experts,

    I came to USA in May 2007 on H4 and got my H1B in October 2008.

    I started working from Octber 1, 2008 and gets paid on 5th of next month. Accordingly, I will receive my December pay on Januray 5, 2009. This makes my December pay to fall in 2009 tax year, and I will receive W2 for only two months in 2008(October & November). This is how my employer does for all employees.

    Since, I have not yet got my visa stamped for H1B, Will this be a problem. Is there any official rule for H1B holders that you should have a W2 for 3 months? If yes please guide as early as possible because my employer has no issues giving me a pay cheque on december 31, 2008. But if there is no such rule, it will reduce my tax burden for atleast one time.

    This situation is common and you need not be worried. Your pay stubs will clearly say when you were getting paid. W2 isn't an issue.
